British citizenship by marriage
If you're married to (or in a civil partnership with) a British citizen, you have a faster path to a British passport than almost any other route. Same-day citizenship eligibility when your ILR is granted.
The headline rule: same-day eligibility
Most permanent residents have to wait 12 months after ILR before they can apply for British citizenship. Spouses of British citizens are exempt. The moment your ILR is granted, you can submit your citizenship application — no waiting period.
This is by far the most generous shortcut in the UK citizenship system. It saves you a year and the cost of a separate visa extension while you wait.
The timeline
The full path looks like this:
- Marry your British partner (or enter into a civil partnership). The marriage must be legally valid.
- Get a spouse visa (2.5 years initially).
- Extend the spouse visa for another 2.5 years.
- Apply for ILR at the 5-year mark.
- Apply for citizenship — same day ILR is granted, OR any time after.
Total: ~5 years on the spouse visa + processing time. Processing for ILR is usually 3-6 months; citizenship is 6 months. So from your wedding day to your British passport: roughly 6 years.
Eligibility requirements
You must:
- Be 18 or older.
- Have ILR (or, in some rare cases, EEA permanent residence converted to settled status).
- Have been physically present in the UK 3 years before the date of your citizenship application.
- Have spent no more than 270 days outside the UK in those 3 years.
- Have spent no more than 90 days outside the UK in the 12 months immediately before the application.
- Pass the Life in the UK Test (single pass covers ILR + citizenship).
- Meet the English language requirement at B1 CEFR level.
- Be of good character (no recent criminal convictions, no immigration breaches).
- Intend to continue living in the UK.
Your British spouse must:
- Be a British citizen (not just ILR — a citizen) on the date of your application.
- Still be married to you and living together (or in a recognised civil partnership).
- Confirm the relationship is genuine.

Home Office fees change every April. Always confirm current rates at gov.uk before applying. Solicitor costs (if you use one) typically add another £1,500-£4,000 across all the applications.
What's the difference between this and the standard route?
The standard naturalisation route (e.g. Skilled Worker → ILR → 1-year wait → citizenship) takes 6 years. The spouse route also takes ~6 years but the year you'd otherwise spend waiting after ILR is skipped. Net savings: about £1,200 in visa fees + Immigration Health Surcharge during that year.
What if my partner gets British citizenship after we marry?
You can still benefit from the same-day rule. Your spouse just needs to be a British citizen on the date you submit your citizenship application — not necessarily on the date you married.
Common pitfalls
- Counting student-route or work-route time: Time spent on visas other than the spouse route doesn't count toward the 5-year clock. If you switched from a Skilled Worker visa to a spouse visa, your clock restarts on the spouse visa.
- Absences over the limit: 270 days total across 3 years and 90 days in the final year are hard limits. Track every trip carefully.
- Marriage breakdown before ILR: If you divorce before ILR, you usually lose eligibility on the spouse route. Get legal advice immediately.
- Spouse not yet a citizen: If your partner has ILR but hasn't yet naturalised, you can't use the same-day-citizenship rule. They'd need to naturalise first, OR you wait the standard 1 year after your own ILR.
